Question from August, 2007:

Question:
"I have been very busy with work lately so I haven't had time to go to Town Hall lately. What is the current status of the Crossroads 40B excess profit of $700K that the Inspector General found ? Last I heard was that the Developer and the Town were in negotiations. Just curious when this would get resolved and how much we can add to the affordable housing budget."

Answer:
The situation referred to involves at least potential litigation so I am not free to discuss all aspects. Suffice it to say that the Town of Acton government has been closely following the ongoing interaction between the Inspector General's Office and the developer, but not interfering with that State process. The Board of Selectmen recently authorized staff to file suit, but to offer a standstill agreement to the developer re any statute of limitations, so that Acton's rights to fully litigate the issue of alleged excess profits can, if necessary, be fully litigated.
F. Dore' Hunter
Chairman, Board of Selectman
